Nation’s top trade groups hail SCOTUS ruling after filing emergency appeals against Biden’s vaccine mandate

On Thursday, the Supreme Court froze a lower court opinion that had allowed the mandate to go into effect across the country. The Biden Administration of Vaccination and Temporary Emergency COVID-19 Testing has directed companies with more than 100 employees to request vaccinations or mandatory weekly testing for employees under the Occupational Safety and Health Administration, which protects safety in the workplace. The mandate will affect 80 million workers.

NRF joined more than 26 other trade associations this week and submitted oral arguments to the court. Retail is the nation’s largest private sector employer supporting 52 million Americans. Union-related builders and contractors and American Trucking Associations were two of the groups that filed emergency appeals to the Supreme Court.

“Trucking has been on the front lines throughout the pandemic — delivering personal protective equipment, medical supplies, food, fuel, and even the vaccines themselves. Thanks to this ruling, our industry will continue to deliver essential commodities, as our nation recovers from the trucking associations,” said Chris Speer, CEO of Trucking Associations. The National Federation of Independent Business, which petitioned the Supreme Court, argued that there should have been a period of notice and suspension before the mandate was created. The group also said the nationwide testing and vaccine mandate should be left to Congress, and that the authorization would further exacerbate the challenges facing small businesses.

“As small businesses try to recover after nearly two years of significant business turmoil, the last thing they need is a mandate that will cause more business challenges. We are pleased that the Supreme Court has halted enforcement of the rule while the courts consider whether the Harand, executive director of the NFIB Small Business Legal Center, this is legal.”

The National Retail Federation called on President Biden to back down after today’s ruling.

“The NRF urges the Biden administration to eliminate this illegal mandate and instead work with employers, employees and public health experts on practical ways to increase vaccination rates and mitigate the spread of the virus in 2022,” French said.

Joshua Bolten, chief executive of the Business Roundtable – an influential lobby group made up of top US executives – said the organization respected the court’s ruling.

“Before the mandate was announced, many of our companies led their own vaccination efforts,” he said. “While companies may take different approaches based on their unique circumstances and diverse workforce, employee and customer safety remains paramount, and efforts to promote vaccination will not falter.”
